To accomplish this with you and all other guests, we have created these rules and guidelines.
By entering Fun Beach you agree to the following.

Art. 1. APPLICABILITY

When purchasing a ticket, e-ticket or subscription (hereinafter also referred to as 'entrance ticket'), the buyer expressly and without reservation accepts the applicability of these regulations. The regulations are available for inspection when buying a ticket at the entrance. When buying an e-ticket or a subscription via the internet, you must indicate that you have read these regulations and that you agree with their applicability.
As soon as you enter the site or the company, you accept the applicability of these regulations and you are obliged to strictly follow all regulations and instructions given by our employees. For all cases and/or situations not covered by these regulations, we reserve the right to set additional rules orally and/or in writing to which visitors are bound.

Art. 2. Parking

The same rules apply in our parking lot as on public roads. In order to prevent stagnation in traffic, the instructions of our parking attendants must be followed. If you do not or poorly follow the traffic rules and/or instructions, we are entitled to remove the vehicle from the parking lot at your risk and expense. Bicycles, mopeds, scooters and motorcycles must be parked in the designated parking facilities.
We are not liable for theft from or damage to your vehicle, unless the damage is the result of a shortcoming that can be attributed to the management or our park employees. This also applies if damage is caused by storm, fire, hail, explosion or other extraordinary events. We are entitled, to increase our control, to stick parking stickers on one of the windows of your vehicle. You must report damage to your vehicle before leaving our park. We are not liable for damage to your vehicle, unless the damage is the result of a shortcoming on the part of the management or our park employees.
Season ticket holders have no priority and no guarantee of a (permanent) parking space: full = full.

Art. 3. SAFETY RULES

Fire/police regulations and indications must be followed. It is forbidden to make fire. It is forbidden to bring nitrous oxide bottles onto the site. Smoking is not allowed in the buildings and attractions, unless indicated otherwise. Possessing and carrying weapons or objects that could pose a danger is prohibited during a visit to our park. Our park employees are authorized to confiscate these weapons and objects, or to remove the owner from our park. The instructions of our park employees must be followed completely and immediately. This serves your own interest and that of fellow visitors.
Making unnecessary noise and loudly playing music carriers etc. is not allowed. Our park employees are authorized to temporarily confiscate sound equipment in the event of nuisance. Physical or verbal violence, or otherwise undesirable behavior towards other visitors and our staff will not be tolerated. If necessary, the police will be called in. Waste must be deposited in the waste bins present at our park. Our grounds are carefully maintained. If you are nevertheless confronted with an unsafe situation and/or damage, please report this to one of our employees as soon as possible. Even if you cause damage yourself, we request that you report this to one of our employees before you leave the site.

Art. 4. ENTRANCE

Entering our park is at your own risk. Our park may only be entered with a valid admission ticket. You must keep the admission ticket during your stay in our park and show it at the request of a park employee. Additional entrance fees may be requested for the entire park or parts of our park. Also, parts of our park or our entire park can be rented out to third parties on certain days, so you will not have access. Fun Beach is under no circumstances obliged to refund the entrance fee or subscription fee in whole or in part.
Access may be refused or denied to persons who appear to be under the influence of alcohol or narcotics, or who are dealing or in possession of narcotics, or who otherwise disrupt the order. Animals (with the exception of Soho dogs) are not allowed in our park.
We reserve the right to change opening days and/or times during the season. In connection with the safety of our visitors, we reserve the right to close our doors/gates in the event of excessive visitor numbers.

Art. 5. LIABILITY

Fun Beach is not liable for accidents, loss, theft or damage. Fun Beach is only liable if there is intent or gross negligence or an attributable shortcoming on the part of the management or our park employees. Liability for other damage is hereby expressly excluded. We are not liable for consequential damage, including trading loss and loss of income. Insofar as we cannot successfully invoke the aforementioned limitations of liability, we are liable to the maximum for the amount that is paid out under the liability insurance in the relevant case, supplemented by the amount of our deductible. We advise you to take your safety into account when wearing clothing. This includes, for example, not wearing rings, necklaces, headscarves and other loose clothing.

Art. 6. USE OF AQUAPARK, SUPER SLIDE AND AMENITIES

Unless otherwise indicated, the Aquapark and other facilities are available. Where it is stated (for example for the Super Slide), you must pay for the use. When using attractions and other facilities, the instructions/rules of use, which appear on the signs or are indicated by the park employees, must be followed. A number of attractions have restrictions for use, for example a minimum or maximum height or age. For safety reasons, you are obliged to comply with these regulations. If you do not follow the instructions/rules of use, our park employees are entitled to deny you the use of the attraction or the facility, without you being able to claim compensation. This also applies if you try to get ahead of the waiting queue.
Tents are prohibited. Double windshields are allowed if properly secured. Barbecuing is not allowed.
Using your own drinks and food is allowed, with the exception of alcoholic drinks and glassware. We are not liable for damage resulting from failure to follow the instructions/rules of use.
Our park employees are authorized to decommission/keep an attraction or part of our park out of use at their own discretion, without this giving any right to a refund of (part of) the admission ticket. The use of attractions and playground equipment is entirely at your own risk. Swimming, playing football and other forms of recreation are also entirely at your own risk. The Little Beach section is only accessible to families with children up to the age of 12 and their accompanying adults. Smoking and music are not allowed here.

Art. 7. SUPERVISION

We point out to all parents and supervisors of children and groups that they are responsible for those who visit our park under their supervision. This means that parents and supervisors are also liable for the damage caused by those entrusted to them. Unaccompanied children may be refused access to our park. There are no lifeguards on duty. For those who do not have swimming skills, floaties or other flotation devices are strongly recommended. Both visible and invisible cameras are present to protect everyone's safety and property.

Art. 8. DAMAGE REPORTS

Our park is maintained as carefully as possible. If damage is nevertheless caused, you must report this immediately and before departure. In the event of a later report, you cannot claim any compensation. You may have caused damage unintentionally. In that case too, we request that you report this to us before you leave our park. If you notice situations that could possibly lead to damage, we request that you inform us about this.

Art. 9. REMOVAL

Our park employees are entitled to remove persons who oppose or do not comply with these park regulations from our park. Such removal does not entitle to a refund of the entrance fee or any possible compensation.

Art. 10. RENTAL OF PRODUCTS

(e.g. pedal boats, canoes, beach beds, umbrellas, etc.)
The product may only be used in accordance with its normal destination and must be returned to Fun Beach in the condition in which the product was received. The renter is liable for damage to or loss of the product or parts thereof. The rent incl. deposit is paid online or in cash in advance, unless stated otherwise.
The rental period is the period between the times of commencement and return of the product as stated on the ticket or agreed verbally. Extension of the rental period can only take place after permission from Fun Beach and at the applicable (extension) rates.
Interim return of the product will terminate the rental without entitlement to a reduction of the rental sum. The product must be returned to an agreed location no later than the agreed (and possibly recorded) time of return. If the product is returned without damage and at the set end time, the tenant will receive the deposit back via return debit card or cash payment. If the product is damaged or returned too late, Fun Beach has the right to retain the deposit amount, without prejudice to Fun Beach's right to full compensation.

Art. 11. ONLINE TICKETING/ENTRY TICKET

It is only possible to buy tickets online. These e-tickets are provided with a unique QR code. The e-tickets can be downloaded immediately after payment, after which the e-tickets will be sent digitally to the specified e-mail address. We are not liable if the e-mail address entered by the buyer is incorrect and/or if his e-mail account is not working correctly. The buyer must print the e-tickets himself in good quality and take them to the entrance of the park, or show the e-tickets on his mobile at the entrance of the park, where the e-tickets will be checked. The visitor must, on a first request, also be able to present his ticket to our employees at the park during his visit.
E-tickets also entitle you to free use of the Aquapark, Summer skating and other attractions. The QR code on the e-ticket or subscription must be shown for this.
Each e-ticket can only be used once. The e-ticket loses its validity when you leave the park. The QR codes on the e-tickets may not be folded or damaged. Access to the park may be refused with illegible tickets.
The legal cooling-off period of the number of days according to the 'Distance Buying Act' does not apply to the purchase of e-tickets by date due to the limited validity of the e-tickets. E-tickets cannot be exchanged for money and cannot be exchanged for another date.

We reserve the right to refuse or cancel an order without giving any reason. The buyer will be informed of this by e-mail. If, due to technical malfunctions of any kind, the payment cannot be processed correctly or on time and/or authorized, your e-ticket is not valid, we do not accept any liability in this regard.
It is not permitted to use e-tickets for commercial purposes without written permission from us. E-tickets cannot be used in combination with other promotions and/or discounts, unless stated otherwise. If the validity date of the e-tickets has expired, it is not possible to exchange them and there is no right to a refund. We respect the privacy of all users of our website and ensure that the personal information that the buyer provides to us is treated confidentially. If the buyer grants permission for this, for example by checking or unchecking the request to use his/her personal data, the personal data will be used to keep the buyer informed of our new products and services.

Art. 12. SUBSCRIPTIONS

It is only possible to take out a subscription via the internet. The subscription is provided with a unique QR code and passport photo of the buyer. The subscription is after
payment will be immediately sent digitally to the specified e-mail address. We are not liable if the e-mail address entered by the buyer is incorrect and/or if his e-mail account is not working correctly. The buyer must print the subscription in good quality and take it with him to the entrance of the park, or show the subscription on his mobile at the entrance of the park, where it will be checked. Each subscription is valid for one year from the date of purchase. The QR code on the subscription may not be folded or damaged. Access to the park may be refused with illegible QR codes. To identify a subscription, you must temporarily remove a headgear, sunglasses or other clothing that covers your face at our request. Personal privacy is hereby respected.

The legal cooling-off period of the number of days according to the 'Distance Buying Act' does not apply to the purchase of the subscription, as the buyer is entitled to access the park immediately after taking out the subscription. We reserve the right, without giving any reason, to refuse or cancel an order. The buyer will be informed of this by e-mail. If, due to technical malfunctions of any kind, the payment cannot be processed correctly or on time and/or authorized, your e-ticket is not valid, we do not accept any liability in this regard.
Subscriptions remain the property of our park. Subscription passes may not be used by third parties, traded and/or resold. They can be confiscated if the owner behaves improperly or acts contrary to these park regulations.

A subscription holder is always entitled to access to the park! However, he should a limited number of places on Fun Beach can be registered for his arrival via our online booking system at www.funbeach.nl. Access is not possible without registration. Each subscription holder has the option to reserve a maximum of 3 visiting days at a time. The season ticket holder can register for a visit up to one day in advance (12:00 noon). If he has already booked 3 visiting days, the next booking option is as soon as a visiting day has passed. The visiting days can be reserved as long as the subscription is valid.
On your reserved visiting day, the season ticket holder will receive a reminder email at 08:00 in the morning.
This e-mail also contains a link with which the subscription holder can unsubscribe from the visit. This is possible until 10.00 am on the day itself! Cancellations after 10:00 am can no longer be processed. Of course you can unsubscribe earlier via the personal account. If the subscription holder had registered, but did not make use of the reservation, a first "no show" will be received by e-mail at 7 p.m. In case of a 2nd “no show”, it is only possible to register for a new day by paying a one-off entrance ticket of € 8.50. After this payment, the subscription will be released again for registration.

It is not permitted to use subscriptions for commercial purposes without written permission from us. Subscriptions cannot be used in combination with other promotions and/or discounts, unless stated otherwise. We respect the privacy of all users of our online booking system and ensure that the personal information that the buyer provides to us is treated confidentially. If the buyer grants permission for this, for example by checking or unchecking the request to use his/her personal data, the personal data will be used to keep the buyer informed of the expiration of the subscription or our new products. and services.

Art. 13. IMAGE, SOUND, SALES AND PRIVACY

Promoting or selling services and/or articles in the parking lot and in our park is not permitted without written permission from the park management. It is possible that during your visit to our park, film and image material will be made by or on behalf of Fun Beach, which can be used as promotional and/or sales material. No rights can be derived from this and you also do not object to the use of these images. (TV) recordings can take place in the park at all times. If you don't want to be in the picture, avoid the locations where a film crew is at work. It is forbidden to make recordings for commercial purposes without prior permission from Fun Beach. Film crews and photographers who report as such at the entrance may be denied access to the park.
Publication of image and/or sound material showing the site and/or company is prohibited, unless Fun Beach has given written permission in advance. If this permission has not been granted in writing, Fun Beach hereby grants in advance a worldwide, non-exclusive, royalty-free license to publish and reproduce what has been published without permission. If these recordings are used in a broader context, such as a news item, Fun Beach is also entitled to publish and reproduce this broader context again. The person who makes the recordings undertakes to inform the person who makes the broader context in good time of this right of Fun Beach and to obtain permission for this. Any claims made by the party that made the broader context will be met by the person making the recordings. The recording party agrees to the claims being made directly to it by the party that made the context and indemnifies Fun Beach against any liability in this regard.
Fun Beach can oppose the publication and reproduction of copyrighted works by third parties who do not have Fun Beach's permission. Taking photos and films is allowed, provided it is for private purposes.

Art. 14. FORCE MAJEUR

If we are unable to meet our obligations due to force majeure, there is no right to a refund and/or (damage) compensation. In these regulations, force majeure means, in addition to what is understood in this respect by law and jurisprudence, all external causes, foreseen or unforeseen, over which we have no influence, but as a result of which we are unable to fulfill our obligations. This includes in any case, but not exclusively: evacuation of the park by emergency services such as the fire brigade, police and/or ambulance personnel. But also in case of fire, accident, illness, pandemic, insufficient water quality, strike, riot, war, government measures and transport restrictions.

Art. 15. ALGEMEEN

Visitors must hand in items found on the site to our employees. In cases not covered by these park regulations, the judgment of our park employees applies. The invalidity of any provision in these park regulations does not affect the validity of all other provisions. We wish you Fun Beach Day and hope that these park regulations will contribute to that.
