Fun Beach park PARk regULATIONS & GUIDELINES

We would like to give you a Fun Beach Day. In order to be able to achieve this together with you and all other guests, we have drawn up these regulations and guidelines. By entering our Fun Beach you agree to the following.

 

Article 1. APPLICABILITY
When buying a ticket, e-ticket or a subscription (hereinafter referred to as 'entrance ticket'), the buyer expressly and without reservation accepts the applicability of these regulations. When buying a ticket at the entrance, the regulations are available for inspection. When buying an e-ticket or taking out a subscription over the Internet, it should be checked that you have read these regulations and that you agree with its applicability.
As soon as one enters the premises or the company, one accepts the applicability of the present regulations and is obliged to follow all the regulations and the instructions given by our employees promptly. For all cases and/or situations in which this regulation does not provide, we reserve the right to set additional oral and/or written additional rules to which visitors are required.

 

Article 2. PARKING
The same rules apply in our parking lot as on public roads. In order to avoid traffic stagnation, the instructions of our parking attendants must be followed. If you do not follow the traffic rules and/or directions, we are entitled to remove the vehicle from the parking lot at your risk and at your expense. Bicycles, mopeds, scooters and motorbikes must be parked in the designated storage.
We are not liable for theft or destruction of your vehicle unless the damage is the result of a defect attributable to the management or our park employees. This also applies if damage is caused by storms, fires, hail, explosions or other extraordinary events. We are entitled, to increase our control, to stick parking stickers on one of the windows of your vehicle. Damage to your vehicle must be reported before departure from our park. We are not liable for damage to your vehicle, unless the damage is due to a failure of the management or our park employees.
Subscription holders have no priority and no guarantee of a (fixed) parking space: full = full.

 

Article 3. SAFETY RULES
Fire regulations and indications should be followed. It is forbidden to make fire. It is forbidden to bring nitrous oxide bottles on site. Smoking is not permitted in the buildings and attractions unless otherwise stated. The possession and carrying of weapons or objects, which may pose a danger, is prohibited during the visit to our park. Our park employees are authorized to confiscate these weapons and objects or remove the owner of them from our park. The instructions of our park employees must be followed, completely and immediately. This is serving your own interests and that of fellow visitors.
Unnecessary noise and loud playback of music carriers etc. is not allowed. Our park staff are authorized to temporarily confiscate sound equipment in case of a nuisance. Physical or verbal abuse, or otherwise unwanted behaviour towards other visitors and our staff will not be tolerated. If necessary, the police will be called in. Waste must be deposited in the waste bins on our park. Our site is carefully maintained. If you do face an unsafe situation and/or damage, report this to one of our employees as soon as possible. Even if you cause damage yourself, we ask you to report this to one of our employees before you leave the premises.

 

Article 4. ACCESS
Entering our park is at your own risk. Our park may only be entered with a valid admission ticket. The admission ticket must be stored during the stay in our park and shown at the request of a park employee. Extra entrance fees can be requested for the whole of our park or parts of our park. Also, parts of our park or entire park can be rented out to third parties on certain days, so you do not have access. Fun Beach is under no circumstances obliged to refund all or part of the entrance fee or subscription fee.
Persons who are found to be under the influence of alcohol or narcotics or who are acting or in possession of narcotic drugs, or otherwise disturbing order, may be refused or denied entry. Animals (with the help of Soho dogs) are not allowed in our park.
We have the right to change opening days and/or times during the season. Due to the safety of our visitors, we reserve the right to close our doors/gates in case of excessive visitor numbers.

 

Article 5. LIABILITY
Fun Beach is not liable for an accident, loss, theft or damage. Fun Beach is only liable if there is intent or gross negligence or an attributable shortcoming on the part of the management or our park employees. Liability for other damage is hereby expressly excluded. We are not liable for consequential damage, including loss of profits and loss of income. Insofar as we cannot successfully invoke the aforementioned liability limitations, we will be fully liable for the amount paid out in the relevant case under the liability insurance supplemented by the amount of our deductible. We advise you to take your safety into account when wearing clothes. This could include not wearing rings, necklaces, headscarves and other loose clothing.

 

Article 6. USE OF AQUAPARK, SUPER SLIDE AND AMENITIES
Unless otherwise stated, the Aquapark, SuperSlide and other facilities are available. Where stated, you have to pay for the use. When using attractions and other facilities, the instructions / rules of use, which appear on the signs or are indicated by the park employees, must be followed. Some attractions have restrictions on use, for example a minimum or maximum height or age. For safety reasons, you are obliged to comply with these regulations. If you do not follow the instructions / rules of use, our park employees are entitled to deny you the use of the attraction or the facility, without you being entitled to compensation. This also applies if you try to get in line with the people waiting.

Tents are prohibited. Double windshields are allowed if properly secured. Barbecuing is not allowed.
The use of own food is allowed, with the exception of alcoholic drinks and glassware. We are not liable for damage resulting from failure to follow the instructions / rules of use.
Our park employees are authorized to decommission / keep an attraction or part of our park out of use at their own discretion, without this giving any right to a refund of (part of) the admission ticket. The use of attractions and playground equipment is entirely at your own risk. Swimming, football and other forms of recreation are also entirely at your own risk. The Little Beach section is only accessible to families with children under 12 and their adult companions. Smoking and music are not allowed here.

 

Article 7. SUPERVISION
We remind all parents and supervisors of children and groups that they are responsible for those who visit our park under their supervision. This means that parents and supervisors are also liable for the damage caused by those entrusted to them. Unaccompanied children may be refused entry to our park. No lifeguards are present. For those who do not have a swimming certificate, armbands are urgently recommended. Both visible and invisible cameras are available to protect everyone's safety and property.

 

Article 8. DAMAGES
Our park is maintained as carefully as possible. If, nevertheless, damage is caused, you must report this immediately and before departure. You cannot claim any compensation for subsequent notification. It is possible that you have accidentally caused damage. In that case, too, we request that you report this to us before you leave our park. If you notice situations that could possibly lead to damage, we ask you to inform us about this.

 

Article 9. DISPOSAL
Our park employees are entitled to remove persons who oppose or do not comply with these park regulations from our park. Such removal does not entitle you to a refund of the admission price or any possible compensation.

 

Article 10. RENTAL OF PRODUCTS (eg pedal boats, canoes, beach beds, umbrellas, etc.)
The product may only be used in accordance with its normal destination and must be returned to the lessor in the state in which the product was received. The tenant is liable for damage to or loss of the product or parts thereof. The rent is determined on the basis of the rates applicable when entering into the lease with the landlord, as these are clearly stated or are available for inspection. The rent is paid in cash in advance, unless stated otherwise.
The rental period is the period between the times of commencement and return of the product as stated in the contract or agreed orally. Extension of the rental period can only take place after permission from the landlord and at the applicable (extension) rates.
Submitting the product prematurely will terminate the lease without entitlement to a reduction of the rent. The product must be returned to an agreed location at the latest on the agreed (and possibly recorded) time of return. Any deposit serves to pay all that the tenant owes to the landlord under the tenancy agreement without prejudice to the tenant's obligation to pay any remaining amount in cash after settlement with the deposit, without prejudice to the landlord's right to full compensation.

Article 11. ONLINE TICKETING / ENTRANCE TICKET
It is only possible to buy tickets via the internet. These e-tickets are provided with a unique barcode. The e-tickets can be downloaded immediately after payment, after which the e-tickets are sent digitally to the specified e-mail address. We are not liable if the email address entered by the buyer is incorrect and / or if his email account does not work correctly. The buyer must print the e-tickets in good quality and bring them to the entrance of the park, or show the e-tickets on his mobile at the entrance of the park, here the e-tickets will be checked . The visitor must, upon first request, also be able to present his ticket to our employees at the park during his visit.
E-tickets also entitle you to free use of the Aquapark, Summer skating and other attractions. The barcode on the e-ticket or subscription must be shown for this.
Each e-ticket can only be used once. The e-ticket loses its validity when you leave the park. The barcodes on the e-tickets may not be folded or damaged. Entry to the park may be refused for illegible tickets.
The statutory cooling-off period of the number of days according to the 'Distance Selling Act' does not apply to the purchase of the e-tickets by date due to the limited validity of the e-tickets. E-tickets are not exchangeable for money and cannot be exchanged for another date.

We reserve the right to refuse or cancel an order without giving any reason. The buyer will be notified of this by e-mail. If, due to technical failures of any kind, the payment cannot be processed correctly and / or is not processed on time and / or authorized, your e-ticket is not valid, we do not accept any liability in this regard.
It is not allowed to use our e-tickets for commercial purposes without written permission. E-tickets cannot be used in conjunction with other promotions and / or discount promotions unless otherwise stated. If the validity date of the e-tickets has expired, it is not possible to exchange them and there is no right to a refund. We respect the privacy of all users of our website and ensure that the personal information that the buyer provides to us is treated confidentially. If the buyer grants permission to do so, for example by checking or unchecking the request to use his / her personal data, the personal data will be used to keep the buyer informed of our new products and services.

 

Article 12. SUBSCRIPTIONS
It is only possible to take out a subscription via the internet. The subscription is provided with a unique barcode. After payment, the subscription will be sent digitally immediately to the specified email address. We are not liable if the email address entered by the buyer is incorrect and / or if his email account does not work correctly. The buyer must print the subscription in good quality and bring it to the entrance of the park, or show the subscription on his mobile at the entrance of the park, here it will be checked.
Each subscription is valid for one year from the date of purchase. The barcode on the subscription may not be folded or damaged. Entry to the park may be refused for illegible barcodes. To identify a subscription, you must remove a headgear, sunglasses or other face-covering clothing at our request. Privacy is respected here.

The statutory cooling-off period of the number of days according to the 'Distance Selling Act' does not apply to the purchase of the subscription, since the buyer has right of access to the park immediately after the subscription has been taken out. We reserve the right, without giving any reason, to refuse or cancel an order. The buyer will be notified of this by e-mail. Subscriptions remain the property of our park. Subscription passes may not be used by third parties, traded and / or resold. They can be taken if the owner behaves improperly or acts contrary to these park regulations.

A subscription holder is always entitled to access the park! However, due to a limited number of places on Fun Beach can be registered before coming via our online booking system at www.funbeach.nl. Access is not possible without registration. Each subscription holder has the option to book a maximum of 3 visiting days at a time. The subscriber can register for a visit up to one day in advance (12:00 noon). If he has already reserved 3 visiting days, the next booking option is as soon as a visiting day has passed. The visiting days can be reserved as long as the subscription is valid.
On your reserved visit day, the subscription holder will receive a reminder email of the registration at 08:00 in the morning.
This e-mail also contains a link with which the subscription holder can unsubscribe from the visit. This is possible until 10:00 in the morning on the day itself! Cancellations after 10:00 can no longer be processed. Of course you can unsubscribe earlier via the personal account. If the subscriber has registered, but has not made use of the reservation, a first "no show" will be received by e-mail at 7 pm. With a 2nd “no show”, you can only register for a new day by paying a one-time admission ticket of € 8.00. After this payment, the subscription is released for registration again.

It is not allowed to use our subscriptions for commercial purposes without written permission. Subscriptions cannot be used in conjunction with other promotions and / or discount promotions unless otherwise stated. We respect the privacy of all users of our online booking system and ensure that the personal information that the buyer provides to us is treated confidentially. If the buyer grants permission to do so, for example by checking or unticking the request to use his / her personal data, the personal data will be used to keep the buyer informed of the expiration of the subscription or our new products. and services.

 

Article 13. PICTURE, SOUND, SALES AND PRIVACY
Promoting or selling services and / or articles in the parking lot and in our park is not permitted without written permission from the park management. It is possible that during your visit to our park film and images are made by or on behalf of Fun Beach, which can be used as promotion and / or sales material. No rights can be derived from this and you do not object to the use of these images. (Television) recordings can be made in the park at any time. If you don't want to come into the picture, avoid the locations where a film crew is at work. It is prohibited to make recordings for commercial purposes without prior permission from Fun Beach. Film crews and photographers who report as such at the entrance can be denied access to the park.
Publication of image and / or sound material with the site and / or company on it is prohibited, unless Fun Beach has given prior written permission. If this permission is not granted in writing, Fun Beach is hereby granted a worldwide, non-exclusive, royalty-free license in advance to make public and reproduce the published information without permission. If these recordings are used in a broader context, such as a news item, Fun Beach is also entitled to make this broader context public again and to reproduce it. The person who makes the recordings undertakes to inform the person who makes the broader context of this right of Fun Beach in time and to obtain permission for this. Any claims from the party that has made the broader context will be met by the person making the recordings. The receiving party agrees to direct claims to it by the party that has made the context and indemnifies Fun Beach from any liability in this regard.
Fun Beach can oppose the publication and reproduction of copyrighted works by third parties that do not have the permission of Fun Beach. Taking photos and movies is allowed, for private purposes.

 

Article 14. FORCE MAJEURE
If we are unable to meet our obligations due to force majeure, there is no right to a refund and / or (damage) compensation. In these regulations, force majeure means, in addition to what is understood in this respect in law and jurisprudence, all external causes, foreseen or not foreseen, over which we cannot influence, but as a result of which we are unable to fulfill our obligations. This includes, but is not limited to: fire, accident, illness, pandemic, insufficient water quality, strike, riot, war, government measures and obstacles to transport.

 

Article 15. GENERAL
Visitors must hand in found objects on site to our employees. In cases for which these park regulations do not provide, the opinion of our park employees applies. The invalidity of any clause in these park regulations does not affect the validity of all other clauses.
